Yair Shilo, Managing Senior Partner, Executive

Adv. Shilo graduated with honors from the Hebrew University in 1989 (after being a member of the Dean’s list in each of his degree years). Upon graduation, Adv. Shilo specialized in the Supreme Court with the Honorable Justice (then) Aharon Barak, and later in the firm. Adv. Yarak-Liran. Throughout the years of his studies and internship, Adv. Shilo served as a member of the editorial board, and later as an editor, of the journal “Mishpatim” of the Hebrew University. In addition, Adv. Shilo served as a TA in Criminal Law and Criminal Procedure courses at the Hebrew University of Jerusalem.

On his admission to the Bar, Adv. Shilo worked for eight years at the Jerusalem District Attorney’s Office. During this time, Adv. Shilo gained extensive experience appearing in the courts in all the main areas of law: civil law, administrative law and criminal law. Among other things, Adv. Shilo represented the Jerusalem District Planning and Building Committee in planning and construction petitions, the Ministry of Construction and Housing and the Israel Land Authority in lawsuits by contractors against the state and in land expropriation lawsuits, the Broadcasting Authority in defamation lawsuits, and more.

Adv. Shilo handled complex criminal cases, including a case against the Ministry of Defense’s property in the New York procurement delegation that took bribes, a case against Paz Gas, which was convicted of causing death by negligence for not treating domestic gas facilities, a case against an Israeli gang who robbed a jewelry store in London, and more.

In 1998, Adv. Shilo joined the law firm of Haim Kimhi & Co., and since then he has coordinated the litigation department on the firm. Over the years, Adv. Shilo has handled numerous complex cases (both legal and factual) in courts and arbitration, on a variety of issues. Lawsuits in real estate matters, representation of cooperatives, lawsuits against developer or contracting companies, and representation of public bodies in petitions to the High Court and in administrative petitions on various issues, class actions, defamation and more; Over the years Adv. Shilo has also represented quite a few lawyers who sought his services.

Adv. Shilo serves as a legal advisor to a number of public bodies (including banks, a statutory company, cooperatives and more), and provides an ongoing and comprehensive legal advice to senior management in various areas of activity, including Corporate Law and Administrative Law, Land Law, Corporate Governance, Tenders, (including drafting complex agreements) etc.

Many of those cases in which Adv. Shilo represented resulted in legal precedents in various areas of law; including:

Class actions:

1.1. Arranging the issue of submitting a notice to a third party in a request for approval of a class action (RAA 5635/13 Coral Tel Ltd. v. Avihu Raz et al.);

1.2. Precedent-setting determination as to who is a “customer” who may file a class action against a bank (RAA 2598/08 Bank Yahav for Civil Servants Ltd. v. Lior Shapira);

2. Constitutional and administrative law:

2.1. Precedent regarding the evacuation of graves for urban development (HCJ 52/06 Al-Aqsa v. SWC Museum Corp);

2.2. A precedent that examines the debts of banks when opening branches, to avoid discrimination against the Arab sector (Ref. No. 59462-01-16 Dr. Awad Abu Farih v. The First International Bank Ltd.; CA 1187/18 Dr. Awad Abu Farih V. First International Bank Ltd.);

2.3. Representation of dozens of moshavim in a precedent petition regarding the scope of the authority of the Registrar of Cooperative Societies to intervene in the decisions of the Cooperative Association (p. 321/06 Ron Artzi Group v. Registrar of Cooperative Societies);

3. Civil and Commercial Law:

3.1. Representation of Mishkan Bank / Bank Hapoalim in a precedent-setting case (discussed before a panel of seven judges) on a key question in the field of contract law and wealth-making law and not in law, namely: DNA 10901/08 Beisman v. Mishkan Bank and DNA 6/09 Bank Hapoalim v. Beisman);

3.2. Representation of American Express in a class action lawsuit in the field of competition law (antitrust) that dealt with the clearing fees of credit card companies (RAA 2616/03 Isracard et al. V. Howard Rice).

Adv. Shilo served as legal counsel for the Moriah Municipal Company – Jerusalem Development Company Ltd., and currently serves as legal counsel for a statutory corporation – the Sports Betting Council.
